Third Party Liability Insurance
PURPOSE
The "Civil Liability" insurance for motorists is mandatory insurance for all motorists on the territory of the Republic of Bulgaria. It covers the liability of vehicle owners and drivers for bodily injury and/or death and/or property damage caused to third parties through their fault.
COVERAGE
The coverage limits of the "Civil Liability" insurance for motorists, in accordance with Article 492 of the Insurance Code effective from 07.12.2018 for each event on the territory of the Republic of Bulgaria, are:
- for non-material and material damages resulting from bodily injury or death: up to BGN 10,420,000 per event, regardless of the number of injured persons;
- for property damage (items): up to BGN 2,100,000 per event, regardless of the number of affected persons.
For events that occur in an EU member state, the minimum liability limits applicable in that country shall apply, according to its laws, or the coverage according to the laws of the territory where the vehicle is normally based, if that coverage is higher.
TERRITORIAL SCOPE
The "Civil Liability" insurance for motorists is valid on the territory of EU member states, the European Economic Area, and countries that have signed the Multilateral Agreement "Green Card" (Austria, Belgium, Bulgaria, United Kingdom, Germany, Greece, Denmark, Estonia, Ireland, Iceland, Spain, Italy, Cyprus, Latvia, Lithuania, Luxembourg, Malta, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Hungary, Finland, France, Netherlands, Croatia, Czech Republic, Sweden, plus Andorra, Serbia, and Switzerland).
For the other countries that are members of the "Green Card" agreement - Albania, Bosnia and Herzegovina, Belarus, North Macedonia, Israel, Iran, Moldova, Morocco, Russia, Tunisia, Turkey, Ukraine, Montenegro, and Azerbaijan, a free Green Card certificate is issued, which extends the insurance coverage to be valid in these countries.
INSURANCE TERM
Civil Liability insurance is concluded for a period of one year.
GREEN CARD INFORMATION
The Green Card is an international certificate attached to the "Civil Liability" insurance for motorists, certifying whether the vehicle has valid Civil Liability and whether the policy covers the territory of the relevant country.
For countries that are members of the EU and the European Economic Area, the certificate is not required. There is no border control, and it is not needed when entering the territory of the respective country.
The Green Card certificate is mandatory when traveling to all other countries that are members of the "Green Card" agreement. The document is required when crossing the border, during a roadside inspection, or in case of a traffic accident.
PAYMENT METHODS
Bank Card: Payment is made via a virtual POS on the TollPass platform.
Bank Transfer: Via bank transfer to the bank account of the insurance agent. For this, the client selects this payment method and the Platform generates a Payment Request, which contains a pay code. The client is obliged to specify the pay code in the “payment reason” field of the payment order for each bank transfer. Until the amount is received in the ITS bank account and the transfer is processed, the issued insurance policy is not activated.
Prepaid Balance: Clients with concluded contracts with a prepaid balance can use funds from the balance to pay for insurance policies.
RECEIVING THE INSURANCE POLICY
The insurance policy and all necessary documents related to the concluded “Civil Liability” insurance for motorists are sent free of charge to the address or courier office specified by you, within 3 working days after payment.
In case of installment payments, the delivery of the sticker (cut-out from the mark) is made after the next installment is paid and is free of charge.

CERTIFICATE OF INTELLIGENT TRAFFIC SYSTEMS AD AS AN INSURANCE AGENTT
PRE-CONTRACTUAL INFORMATION
In accordance with Article 325 of the Insurance Code, Intelligent Traffic Systems AD is a registered insurance agent of the Insurer Lev Ins AD ("Insurer"), listed in the registers of the Financial Supervision Commission, which can be verified via the Commission for Financial Supervision, Sofia, ul. “Budapeshta” No. 16 or its website www.fsc.bg, section "Registers and references", "Electronic register and file", "Insurance agents" register. Intelligent Traffic Systems AD does not hold directly or through related parties more than 10 percent of the votes in the general meeting or capital of the insurer. The insurer or its parent company does not hold more than 10 percent of the shares or capital of Intelligent Traffic Systems AD. If a client wishes to file a complaint against Intelligent Traffic Systems AD, it can be submitted in writing to Sofia 1407, Lozenets district, EOS Center, Nikola Y. Vaptsarov Blvd. No. 53B, floor 4, office 6 or by email: support@tollpass.bg, including full name, phone number, and contact address and describing the specific issue. The complaint will be reviewed by Intelligent Traffic Systems AD and forwarded to the insurer within 3 days. Intelligent Traffic Systems AD will issue a decision within 14 days, or up to 1 month if additional data collection is required. Clients may also submit a complaint to the Financial Supervision Commission, ul. “Budapeshta” No. 16 / email: delovodstvo@fsc.bg or to the Sector Conciliation Commission for Insurance Disputes at the CPC, Sofia 1000, Slaveykov Sq. No. 4a, tel. 02/9330 588, website www.kzp.bg, email adr.ins@kzp.bg. Intelligent Traffic Systems AD may accept or decline resolution through the conciliation commission. Any written conciliation proposal made by the commission has no binding effect and must be approved by both parties. Intelligent Traffic Systems AD, in its role as an insurance intermediary, acts on behalf and at the expense of the Insurer under an agency agreement. The company has a contractual obligation to mediate exclusively for one or more insurers and does not provide advice under Article 325a, para. 5 of the Insurance Code. Clients may request advice based on a fair and personal analysis, and Intelligent Traffic Systems AD has the right to accept or refuse. For the insurance mediation performed, resulting in a concluded contract, Intelligent Traffic Systems AD receives remuneration included in the insurance premium in accordance with Article 301, para. 3 of the Insurance Code and paid by the Insurer. The applicable law to the contract is the Insurance Code of the Republic of Bulgaria.
IMPORTANT INFORMATION ABOUT THE RIGHT TO WITHDRAW FROM THE INSURANCE CONTRACT
According to Article 12, para. 1 of the Law on the Provision of Financial Services at a Distance (LPFSD), consumers – natural persons, who are party to a distance financial services contract (in this case, an insurance contract) and act outside the scope of their commercial or professional activity, have the right, without compensation or penalty and without giving a reason, to withdraw from the contract within 14 (fourteen) days from the date of the contract or the day on which they receive the contract terms and information under Article 10, para. 1 and 2, if received later. When exercising the right of withdrawal, the consumer owes the insurer the part of the insurance premium and its tax for the period during which the insurer was at risk (if no insured event occurred), as well as administrative costs, including the cost of the sticker, Green Card certificate, and fees to the Guarantee and Compensation Fund if the insurance entered into force. The insurer is obliged to refund all paid amounts, excluding the above, within 30 days of receiving the withdrawal notice. To exercise the right of withdrawal, the insured must visit the insurer’s office and submit a written withdrawal notice, return the insurance policy, the Green Card certificate, and the relevant cut-out from the mark under Article 487 in accordance with the ordinance under Article 504, para. 1 of the Insurance Code. In case of withdrawal, the consumer must also provide a bank account. Refunds are made only to the policyholder’s account. If the right of withdrawal is not exercised within the specified term, the contract remains valid for its full term.
